Special Advisor to the Chief Prosecutor of the Tribunal Toby Cadman believes that the changes that have been made in the trial process of the International Crimes Tribunal have played a role in raising the standard of justice to a more international level. Toby Cadman made these remarks in response to questions from journalists at the International Crimes Tribunal premises after the hearing on Thursday.

A contempt of court case against former Prime Minister Sheikh Hasina was being heard today. Sheikh Hasina was asked to appear before the tribunal through a newspaper notice. However, she did not appear. The tribunal has appointed senior Supreme Court lawyer AY Moshiuzzaman as an ‘amicus curiae’ (legal assistant to the court) in this case to ensure the transparency of the trial, give the accused another chance and receive the correct interpretation of the law.

Responding to a question from journalists after the hearing, Toby Cadman said that it is important that the trial has begun, although this is not the main allegation. This is encouraging—the tribunal has ensured that the interests of the accused will be protected in this trial.

The special advisor to the chief prosecutor of the tribunal said that it is a very important moment for the people of Bangladesh that the trial has begun and that it is on the right track. Sheikh Hasina was duly summoned to appear before the tribunal. But she did not appear. She has boycotted the trial. She has the right to do so. Nevertheless, the tribunal must properly protect the rights of any accused. In order to ensure justice, this trial needs the broad support of the international community.

Criticism of the trial will continue, believes Toby Cadman. However, he questions the purpose of criticizing from afar without participating in the trial.
